Terms of Service

These terms are the agreement between you and TOC for using the app. We’ve kept them as clear as we can — please read them.

1. Agreement to these terms

These Terms of Service (“Terms”) are a legal agreement between you and TOC Global Pty Ltd (“TOC”, “we”, “us”), a company based in Melbourne, Australia. They govern your use of toccal.com, the TOC web app, and our mobile apps (the “Service”). By creating an account or using the Service, you agree to these Terms and to our Privacy Policy. If you don’t agree, please don’t use TOC.

2. Eligibility

You must be at least 13 years old to use TOC. If you’re under the age of majority where you live, you may only use TOC with the involvement of a parent or guardian. If you use TOC on behalf of a business, you confirm you’re authorised to bind that business to these Terms.

3. Your account

  • Provide accurate information when you sign up, and keep it up to date.
  • You’re responsible for your account and for keeping your password secure.
  • Tell us promptly at hello@toccal.com if you suspect unauthorised use of your account.
  • You can delete your account at any time from in-app settings.

4. Acceptable use

TOC is a place to plan life with the people you trust. You agree not to:

  • Break the law, or use TOC to harm, harass, threaten, or impersonate anyone.
  • Post content that is unlawful, abusive, hateful, or infringes someone else’s rights.
  • Send spam, or invite or message people who don’t want to hear from you.
  • Attempt to access accounts, data, or systems you’re not authorised to access.
  • Interfere with, disrupt, reverse engineer, or place unreasonable load on the Service.
  • Scrape or harvest data, or use the Service to build a competing product.

5. Your content

Your content is yours. You keep ownership of the events, lists, habits, photo logs, captions, and messages you create. You grant TOC a limited, non-exclusive licence to host, store, display, and share that content only as needed to operate the Service for you — for example, showing a photo log to the friends you shared it with. This licence ends when you delete the content or your account, except for content already shared with others or copies we must keep by law.

You’re responsible for your content and confirm you have the rights to share it. We don’t claim ownership of it and we don’t use it to train advertising profiles.

6. Sharing and other people

TOC is social, so some of what you do is visible to people you choose — those you invite to events, lists, habits, and chats, or who follow a business timetable. Be thoughtful about what you share and with whom. We’re not responsible for how other people use content you’ve shared with them. Interactions with other users are between you and them.

7. Business accounts and paid plans

Using TOC for yourself is free. If you run a business on TOC, paid plans apply:

  • Starter — $9.99/month: one bookable timetable, client booking onto their calendar, and regulars tracking.
  • Growth — $19.99/month: everything in Starter, plus multiple timetables per class, room, or instructor.
  • Corporate — custom pricing for larger operations. Contact us for a quote.
  • Additional timetables — $1.99/month each. All prices are in USD unless stated otherwise.

Billing and cancellation

  • Paid plans are billed in advance on a recurring basis until cancelled.
  • You can cancel any time; cancellation takes effect at the end of your current billing period.
  • Except where required by law, payments are non-refundable, and we don’t provide partial-period refunds.
  • We may change plan pricing or features with reasonable advance notice.
  • If you run a business on TOC, you’re responsible for your own dealings with your customers, including bookings, cancellations, and your own privacy obligations.

8. Beta service

TOC is in active development and currently offered in open beta. Features may change, and parts of the Service may occasionally be unavailable. We provide the Service “as is” and do our best to keep it reliable, but we can’t promise it will always be uninterrupted or error-free.

9. Intellectual property

TOC — including the app, the website, our logo, and the “TOC” name — is owned by us and protected by law. These Terms don’t give you any right to use our branding without our written permission. All rights not expressly granted to you are reserved.

10. Disclaimers and limitation of liability

To the maximum extent permitted by law, the Service is provided without warranties of any kind, and TOC isn’t liable for indirect, incidental, or consequential losses, or for lost data or profits, arising from your use of the Service. Nothing in these Terms excludes rights you have under the Australian Consumer Law or other laws that can’t be excluded. Where our liability can’t be excluded but can be limited, it’s limited to resupplying the Service or the amount you paid us in the 12 months before the claim.

11. Termination

You can stop using TOC and delete your account at any time. We may suspend or terminate your access if you breach these Terms or use the Service in a way that risks harm to others or to TOC. On termination, the sections that by their nature should survive — such as content licences already granted to others, intellectual property, disclaimers, and limitation of liability — will continue to apply.

12. Changes to these terms

We may update these Terms from time to time. When changes are material, we’ll update the date above and, where appropriate, notify you in the app or by email. Continuing to use TOC after an update means you accept the revised Terms.

13. Governing law

These Terms are governed by the laws of Victoria, Australia, and you agree to the non-exclusive jurisdiction of the courts of Victoria, without affecting any consumer rights you have under the laws where you live.
